These Terms and Conditions ("Terms") govern your use of the Health Quiz website and quiz funnel services ("Services") operated by BEPO LLC ("we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.
Health Quiz creates, owns, and hosts quiz funnels for healthcare practitioners. Our Services provide healthcare practitioners with access to custom-built health-related quizzes that they can use to engage with their patients and potential patients. We maintain full ownership of all quiz funnels and grant you a limited license to use them for as long as you maintain an active subscription.
As providers of Services to healthcare practitioners, we maintain full compliance with the Health Insurance Portability and Accountability Act (HIPAA). We implement technical, physical, and administrative safeguards to protect the security and privacy of Protected Health Information (PHI) as required by HIPAA.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You agree to use our Services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Services. You further agree not to:
➤ Use the Services in any way that could disable, overburden, damage, or impair the Services
➤ Use any robot, spider, or other automatic device to access the Services
➤ Introduce any viruses, Trojan horses, worms, or other malicious code
➤ Attempt to gain unauthorized access to any parts of the Services
➤ Use the Services to transmit any unlawful, threatening, libelous, defamatory, obscene, or otherwise objectionable information
➤ Create or distribute quizzes that:
ׂ╰┈➤ Falsely claim to diagnose medical conditions
ׂ╰┈➤ Make unsubstantiated health claims
ׂ╰┈➤ Collect information in violation of HIPAA or other applicable laws
Health Quiz is responsible for creating and hosting the quiz funnels. As a subscribing Client, you are responsible for:
➤ Providing accurate requirements for your quiz funnel needs
➤ Using the quiz funnels in compliance with all applicable laws and regulations
➤ Obtaining informed consent from end users
➤ Properly handling any PHI collected through quizzes
➤ Maintaining your own HIPAA compliance
➤ Providing proper disclaimers regarding medical advice
➤ Maintaining an active subscription to retain access to your quiz funnels
Subscription fees must be paid according to the agreed-upon payment schedule. Failure to pay subscription fees may result in immediate suspension or termination of your access to the quiz funnels.
The Services, quiz funnels, and all original content, features, and functionality are and will remain the exclusive property of BEPO LLC and its licensors. Our Services are protected by copyright, trademark, and other laws of the United States. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BEPO LLC.
While we create and own the quiz funnels, Clients have a limited license to use them during the subscription period. Upon termination of your subscription, your access to the quiz funnels will cease, and all rights to use them will revert to us.
While Health Quiz owns the quiz funnels, we may allow you to provide certain customization requests, branding elements, or content suggestions. By submitting such content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of incorporating it into the quiz funnels we create for you.
You retain ownership of your brand elements (logos, color schemes, etc.) that you provide to us for customization purposes, but you grant us permission to incorporate them into the quiz funnels for the duration of your subscription.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
In no event shall BEPO LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
1. Your access to or use of or inability to access or use the Services
2. Any conduct or content of any third party on the Services
3. Any content obtained from the Services
4. Unauthorized access, use or alteration of your transmissions or content
Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied.
BEPO LLC does not warrant that:
➤ The Services will meet your specific requirements
➤ The Services will be uninterrupted, timely, secure, or error-free
➤ The results that may be obtained from the use of the Services will be accurate or reliable
You agree to defend, indemnify, and hold harmless BEPO LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Services, or b) a breach of these Terms.
These Terms shall be governed and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
